1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Student," "you," or "your") and Offscunple Pty Ltd (ABN: 12 345 678 901) ("Offscunple," "we," "us," or "our") regarding your use of our website, services, and public speaking courses.

By accessing our website at offscunple.com, enrolling in our courses, or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Description of Services

Offscunple provides public speaking training services including:

• Foundation and advanced public speaking courses
• Corporate communication training
• Speaking club membership
• Online and in-person workshops
• One-on-one coaching sessions
• Educational resources and materials

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information during enrollment
• Comply with all applicable laws and regulations

4. Course Enrollment and Payment

4.1 Enrollment Process

Course enrollment requires:

• Completion of our enrollment form
• Payment of applicable course fees
• Acceptance of these Terms
• Confirmation from Offscunple

4.2 Payment Terms

• Course fees must be paid in full before course commencement unless alternative arrangements are agreed in writing
• Payment can be made via credit card, bank transfer, or other accepted methods
• All prices are in Australian Dollars (AUD) and include GST where applicable
• Course fees are subject to change with 30 days' notice

4.3 Payment Processing

We use secure third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.

5. Cancellation and Refund Policy

5.1 Student Cancellations

• More than 14 days before course start: Full refund minus $50 administration fee
• 7-14 days before course start: 50% refund
• Less than 7 days before course start: No refund
• After course commencement: No refund

5.2 Offscunple Cancellations

If we cancel a course due to insufficient enrollment or other circumstances beyond our control:

• Full refund of course fees will be provided
• Alternative course dates may be offered
• We are not liable for any additional costs or damages

5.3 Transfer Policy

Course transfers to alternative dates may be permitted with at least 7 days' notice, subject to availability and a $25 administration fee.

6. Student Responsibilities

As a student, you agree to:

• Attend all scheduled course sessions
• Participate respectfully and constructively
• Complete assignments and exercises as directed
• Respect other students and instructors
• Follow course guidelines and policies
• Provide honest feedback for course improvement

7. Code of Conduct

All participants must adhere to our code of conduct:

7.1 Acceptable Behavior

• Respectful communication with all participants
• Constructive feedback and support
• Professional conduct during all activities
• Confidentiality regarding other participants' personal information

7.2 Prohibited Behavior

• Harassment, discrimination, or bullying
• Disruptive or disrespectful behavior
• Recording sessions without permission
• Sharing course materials without authorization
• Commercial solicitation of other participants

7.3 Enforcement

Violation of our code of conduct may result in removal from the course without refund and prohibition from future services.

8. Intellectual Property

8.1 Our Content

All course materials, website content, and resources are protected by copyright and remain the property of Offscunple. You may not:

• Reproduce, distribute, or sell our materials
• Use our content for commercial purposes
• Remove copyright or proprietary notices
• Create derivative works based on our content

8.2 Student Content

By participating in courses, you grant us a non-exclusive license to use student feedback, testimonials, and performance examples for marketing and educational purposes, subject to privacy protections.

9. Privacy and Confidentiality

We are committed to protecting your privacy as outlined in our Privacy Policy. Additionally:

• Course discussions and personal sharing remain confidential among participants
• We may record sessions for quality assurance with prior notice
• Student progress and feedback are kept confidential

10. Disclaimers and Limitations

10.1 Service Disclaimer

Our services are provided "as is" without warranties of any kind. We do not guarantee specific outcomes or results from course participation.

10.2 Limitation of Liability

To the maximum extent permitted by Australian law, our liability is limited to the amount you paid for the specific service. We are not liable for:

• Indirect, consequential, or special damages
• Lost profits or business opportunities
• Personal injury except where caused by our negligence
• Technical failures or interruptions

11. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters or extreme weather
• Government actions or health emergencies
• Technical infrastructure failures
• Transportation disruptions

12. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate your access to our services at any time for:

• Non-payment of fees
